1. The service
DeskForeman provides participating residential contractors with an AI assistant for customer-initiated project conversations by SMS. The current pilot focuses on discovery, builder decisions, builder-authored planning ranges, manually confirmed visits, reminders, and post-visit handoffs. The exact enabled features are shown during onboarding.
2. Builder control and responsibility
The participating contractor remains responsible for prices, quotes, schedules, warranties, permits, safety, contracts, and work performed. DeskForeman may organize facts and prepare wording, but a planning range is not a final quote and a requested visit time is not confirmed until the contractor approves it.
3. Setup and activation
The trial and any subscription term begin at checkout. Immediately after checkout, DeskForeman provisions the account and a dedicated phone number and sends that number to the contractor. Maya only speaks to a customer who messages that number, so the contractor controls when customer messaging starts by choosing when to publish or forward to it. Customer-directed messaging additionally depends on carrier registration of the number, which can take several days and is outside DeskForeman’s control.
4. Fees and cancellation
The price, trial length, renewal date, and billing cadence presented at checkout govern the subscription. A contractor may manage or cancel the subscription through the billing portal or by contacting support@deskforeman.com. Cancellation stops future renewal; it does not retroactively refund a completed billing period unless required by law.
5. Messaging
Contractors must publish accurate opt-in language and use their number only for permitted project messaging. Homeowners can reply STOP to opt out or HELP for support. Additional terms are in the SMS Terms. Contractors may not use DeskForeman for purchased-list outreach, deceptive messaging, unlawful discrimination, emergencies, or highly sensitive data.
6. Account and data
Contractors must keep account access secure, provide accurate business information, and promptly correct outdated facts. DeskForeman handles personal information under the Privacy Policy. Each party retains ownership of the material it provides; the contractor grants DeskForeman the limited rights needed to operate and improve the service.
7. Availability and pilot changes
The pilot may change, pause, or require manual review. DeskForeman does not guarantee uninterrupted delivery, carrier performance, a lead outcome, project revenue, or a particular customer response. Material changes that affect an active subscription are communicated through the account contact.
8. Disclaimers and liability
The service is provided “as is” to the extent permitted by law. DeskForeman is not a contractor, estimator, engineer, attorney, payment processor, or emergency service. To the extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages. DeskForeman’s aggregate liability is limited to amounts paid for the service during the three months before the event giving rise to the claim.
9. Suspension and termination
DeskForeman may suspend access to protect customers, contractors, carriers, or the service; address nonpayment; or investigate prohibited use. Either party may end pilot participation. Provisions concerning payment, ownership, disclaimers, liability, and dispute resolution survive termination.
